Terms of Service
These terms explain the rules for using Chickasha.com, creating an account, and sharing local listings or other content.
01 · Agreement
Acceptance and scope
These Terms of Service (“Terms”) are a binding agreement between you and the operator of Chickasha.com under the Chickasha.com name (“Chickasha.com,” “we,” “us,” or “our”). They apply to the website, account, directory, local news, event calendar, business, job, classified, lodging, listing, checkout, contact, and related features (collectively, the “Site”).
By accessing or using the Site, creating an account, or submitting content, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Site. Additional terms shown for a particular paid feature, submission, contest, or service become part of these Terms when you use that feature.
02 · Membership
Eligibility and accounts
- You must be at least 18, or the age of legal majority where you live, to create and independently operate an account or enter a paid transaction. A younger person must act with a parent or legal guardian’s permission and supervision. Children under 13 may not create accounts or submit personal information.
- Provide accurate, current information and keep it updated. Do not impersonate another person or organization or create an account you are not authorized to control.
- You are responsible for protecting your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
- An account does not give you ownership of a listing, name, category, URL, or placement. We may require reasonable evidence that you are authorized to represent or claim a business, organization, property, event, or job.
03 · Local information
What the Site provides
Chickasha.com is a community information and directory service. It may publish local news, events, practical guides, business and lodging information, employment opportunities, classifieds, user reviews, links, and paid or featured placements. Features may change, move, become unavailable, or be discontinued.
04 · Contributions
Your submissions and license
“User Content” means any listing, job, classified, event, review, response, profile, image, logo, document, link, correction, message, or other material you submit or make available through the Site.
You keep any ownership rights you have in your User Content. By submitting it, you give Chickasha.com a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt for layout or accessibility, publish, display, distribute, excerpt, and promote that content in connection with operating and publicizing the Site. This license allows us to resize images, correct obvious formatting, create previews, categorize information, and show content across Site features. It ends when the content is deleted from our active systems, except for reasonable backup, archive, legal, and previously distributed copies.
You represent that you have the rights and permissions needed to submit the User Content and grant this license; that the content is accurate to the best of your knowledge; and that its collection, publication, and use as described in these Terms will not violate law or another person’s rights.
05 · Community rules
Content and conduct standards
You may not use the Site to submit, promote, link to, or facilitate content or conduct that:
- is illegal, fraudulent, deceptive, defamatory, threatening, harassing, hateful, exploitative, or dangerously misleading;
- violates intellectual-property, privacy, publicity, contract, confidentiality, employment, housing, anti-discrimination, consumer-protection, or other rights or laws;
- impersonates another person or organization or falsely claims authorization, endorsement, ownership, location, credentials, availability, pricing, or results;
- contains malware, malicious code, credential harvesting, spam, unauthorized advertising, pyramid schemes, counterfeit goods, regulated goods offered unlawfully, or instructions for wrongdoing;
- exposes another person’s private information without permission, including sensitive identifiers, financial data, medical data, intimate material, or a private home address;
- is sexually exploitative, involves minors inappropriately, or violates laws protecting children;
- manipulates rankings, engagement, reviews, or reputation through fake accounts, undisclosed conflicts, incentives, copied reviews, or coordinated deception;
- scrapes, probes, overloads, bypasses, reverse engineers, or interferes with the Site or its security, access controls, rate limits, or normal operation; or
- uses Site data to build unsolicited contact lists, spam users, discriminate unlawfully, or create a competing bulk database without written permission.
06 · Urgent safety requests
Nonconsensual intimate-image removal
Real or digitally created intimate images or videos of a person may not be posted without that person’s consent. A person depicted, or an authorized representative, may request removal without creating an account.
Use the contact form with “Urgent Image Removal” in the subject. Identify the exact Chickasha.com URL; identify the person depicted; state that the requester is that person or is authorized to act for them; state in good faith that the image is intimate and was shared without consent; provide reliable contact information; and include a physical or electronic signature. Do not upload or resend the intimate image itself unless we specifically and securely request it.
We will review the request promptly and, where the TAKE IT DOWN Act or another law applies, remove a validly reported image and known identical copies within the legally required period. We may contact the requester for information needed to validate or complete the request. If immediate physical safety is at risk, contact law enforcement or emergency services. 07 · Editorial control
Review, correction, and moderation
We may review, verify, edit for clarity or formatting, categorize, delay, reject, suspend, unpublish, or remove content or accounts. We are not required to publish every submission, explain every editorial decision, monitor all content, or preserve content indefinitely. Automated tools and third-party services may assist with spam, security, duplicate, quality, and policy checks, but human review may still be used.
We may label sponsored or featured content, correct obvious errors, merge duplicates, change categories, or request verification. We may preserve information reasonably needed to investigate abuse, comply with law, resolve a dispute, or prevent repeat violations. If you see an error or a policy problem, use the contact page and include the exact page URL and relevant details.
08 · Directory notices
Listings, jobs, classifieds, events, and transactions
Unless Chickasha.com expressly says otherwise, we are not the seller, buyer, employer, applicant, landlord, tenant, hotel, business, contractor, event organizer, ticket seller, licensing authority, or agent in a transaction between Site users and third parties. A listing is not an endorsement, guarantee, background check, license verification, safety inspection, or promise that an offer is legitimate or available.
- Businesses and lodging: verify licensing, insurance, qualifications, accessibility, pricing, policies, and suitability directly.
- Jobs: employers are responsible for lawful, accurate postings and hiring practices. Applicants should protect personal information and investigate suspicious requests. A post does not guarantee an interview, employment, compensation, or workplace conditions.
- Classifieds: use caution with strangers, advance payments, shipping, gift cards, wire transfers, deposits, and requests for sensitive information. Inspect goods and meet safely where appropriate.
- Events and news: schedules, access, weather plans, tickets, closures, and official instructions may change. Confirm with the organizer or responsible authority.
- Reviews: reviews represent their authors, not Chickasha.com. Reviewers must describe genuine experiences and disclose material relationships or incentives.
Use emergency services—not the Site—for emergencies. Do not rely on Chickasha.com as the sole source for legal, medical, financial, public-safety, weather, evacuation, or other urgent advice.
09 · Purchases
Paid and featured services
If the Site offers a paid, upgraded, advertised, claimed, or featured listing option, the price, currency, duration, included features, and available payment method will be shown during the purchase flow or in a related offer. Review those details before confirming.
- You authorize the selected payment provider and Chickasha.com to process the amount shown and related transaction information.
- Payment providers may impose their own terms and privacy practices. We do not ask you to place payment credentials in a public listing or contact-form message.
- Unless a different refund rule is displayed at purchase or required by law, fees for a service already delivered, activated, reviewed, or featured are nonrefundable. Contact us promptly about duplicate charges, technical errors, or a feature that was not delivered.
- You are responsible for applicable taxes, accurate billing information, and any bank or provider charges.
- Payment does not guarantee approval, factual verification, a particular ranking, traffic, inquiries, sales, employment outcome, or continued publication of content that violates these Terms.
10 · Ownership
Chickasha.com intellectual property
The Site’s original design, branding, compilation, arrangement, software, graphics, and editorial content are owned by Chickasha.com or its licensors and are protected by applicable law. These Terms give you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful personal or internal business purposes.
You may share links to public pages and use ordinary browser functions. You may not reproduce substantial portions of the Site, remove rights notices, use the Chickasha.com name or branding to imply endorsement, frame the Site deceptively, or exploit Site content commercially without permission or another lawful basis.
11 · Rights complaints
Copyright and other rights complaints
If you believe content on the Site infringes your copyright or another right, send a written notice through the contact page with “Copyright Notice” in the subject. Include:
- your name and reliable contact information;
- identification of the protected work or right;
- the exact Chickasha.com URL and a clear description of the disputed material;
- a good-faith statement explaining why the use is unauthorized;
- a statement that the information is accurate and that you are the rights holder or authorized to act for that person; and
- your physical or electronic signature.
We may forward a complaint to the submitter, request more information, remove or restrict material, and take action against repeat infringers where appropriate. Do not knowingly submit a false or misleading complaint.
12 · Outside services
Third-party websites and tools
The Site may link to or use services operated by businesses, government agencies, event organizers, maps, social networks, payment providers, analytics providers, or other third parties. We do not control and are not responsible for their content, products, security, availability, accessibility, terms, or privacy practices. A link, map pin, logo, or mention does not by itself mean endorsement or partnership.
13 · Messages
Communications
We may send service-related messages needed to administer an account, submission, order, support request, security issue, or policy update. If we send marketing email, you may use the unsubscribe method in that message or contact us. You remain responsible for transactional or security messages that cannot reasonably be suppressed while an account or transaction is active.
Do not send passwords, full payment credentials, government identifiers, or unrelated sensitive documents by email or through the contact form.
14 · Enforcement
Suspension, removal, and termination
You may stop using the Site at any time and may request account or personal-information deletion subject to the Privacy Policy. We may restrict, suspend, or terminate access; decline or remove content; cancel a feature; or take protective action if we reasonably believe there is a violation, security risk, legal requirement, nonpayment, abuse, or harm to the Site or others.
Sections that by their nature should continue—including ownership, licenses already needed for distributed or archived content, disclaimers, liability limits, indemnity, dispute terms, and general provisions—survive termination.
15 · Important limits
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, LISTINGS, LINKS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CHICKASHA.COM DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SECURITY, AVAILABILITY, AND RESULTS.
We do not warrant that the Site will be uninterrupted or error-free; that content or users are truthful, qualified, licensed, safe, or suitable; that defects will be corrected; or that a listing, job, classified, event, paid feature, or link will produce any particular result. Some jurisdictions do not allow certain disclaimers, so these limits apply only to the extent permitted.
16 · Responsibility
Limitation of liability and indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHICKASHA.COM AND ITS OWNERS, PERSONNEL, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, OPPORTUNITIES, OR GOODWILL; OR DAMAGES ARISING FROM THIRD-PARTY CONDUCT, CONTENT, TRANSACTIONS, OR UNAUTHORIZED ACCESS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO CHICKASHA.COM FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT OR (B) $100. These limits do not exclude liability that cannot lawfully be limited.
You agree to defend, indemnify, and hold harmless Chickasha.com and its owners, personnel, contractors, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your User Content, your unlawful or unauthorized conduct, your transaction with another person, or your material violation of these Terms or another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.
17 · Disputes
Governing law and resolving concerns
Before filing a claim, please contact us and give us a reasonable opportunity to understand and resolve the concern informally. This does not prevent either party from seeking urgent relief or using a government complaint process where available.
To the extent permitted by law, these Terms and disputes arising from them or the Site are governed by Oklahoma law, without regard to conflict-of-law principles. Any court proceeding must be brought in a court that has lawful subject-matter and personal jurisdiction. Mandatory consumer protections and rights that cannot be waived remain in effect.
These Terms do not require individual arbitration and do not waive a right to participate in a class action where that right otherwise exists.
18 · General provisions
Changes, severability, and other terms
- Changes: We may revise these Terms. The “Last updated” date identifies the current version. Material changes may receive additional notice when required. Continued use after the effective date means the revised Terms apply to future use.
- Severability: If a provision is unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue.
- No waiver: A delay or failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a transfer of the Site or its operations, subject to applicable law.
- Entire agreement: These Terms, the Privacy Policy, and any additional terms presented for a feature are the entire agreement concerning the Site and supersede prior terms on the same subject.
- Headings: Headings are for convenience and do not change meaning.
